01 Acceptance of terms
By downloading, installing, accessing, or using the Spark application or the spark.app website (collectively, the "Service"), operated by Ignite Web Studio ("Spark," "we"), you agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which is an integral part of these Terms. If you do not agree with any of these Terms, do not use the Service. These Terms constitute a binding agreement between you and Ignite Web Studio.
02 Eligibility
To use Spark you must be at least 13 years old. If you are between 13 and 18 years old, you represent that you have obtained consent from your parent or legal guardian to accept these Terms. By using the Service, you represent and warrant that: (a) you meet the legal age requirement, (b) you have legal capacity to enter into this agreement, (c) you are not prevented by law from receiving the Service in your jurisdiction, and (d) you have not been previously suspended or removed from the Service. We reserve the right to refuse service to anyone for any legitimate reason.
03 User accounts
To access certain features of Spark you must create an account by providing truthful, accurate, and current information. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately at spark@ignite-web-studio.com if you detect any unauthorized use of your account or security breach. We are not responsible for losses resulting from unauthorized use of your account if you have not notified us in a timely manner.
04 Subscriptions and auto-renewal
Spark offers a free version with limited features and a Premium plan via monthly or yearly subscription. Premium subscriptions are billed through your Apple App Store or Google Play Store account at the time of purchase. The subscription auto-renews at the end of each billing period at the then-current price, unless you cancel at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time from your App Store or Google Play account settings. Cancellation takes effect at the end of the paid period.
05 Trial periods and refunds
We may offer free trial periods for new subscriptions. By activating a trial period, you authorize automatic billing at the regular price at the end of the trial unless you cancel beforehand. You may only activate one trial period per user. Refunds are subject to the policies of Apple App Store and Google Play Store, as applicable. Spark does not process refunds directly: you must request them from the store where you made the purchase. We do not issue refunds for unused partial periods or unused features.
06 Acceptable use
You agree to use Spark only for personal, lawful purposes and in accordance with these Terms. You agree NOT to: (a) copy, reproduce, redistribute, or sell the Service's content without written authorization, (b) reverse engineer, decompile, or attempt to access the source code, (c) use bots, scrapers, or automated tools to access the Service, (d) circumvent security measures or access controls, (e) interfere with normal Service operation or overload our infrastructure, (f) use the Service for harassment, illegal content, or fraudulent activities, (g) impersonate another person or entity. Violation of these terms may result in immediate suspension or termination of your account.
07 Intellectual property
All content, design, code, functionality, selected texts, sounds, trademarks, logos, and Service materials are exclusive property of Ignite Web Studio or its licensors, and are protected by intellectual property laws of Mexico and international treaties. Phrases attributed to specific authors are in the public domain or used under educational fair use. The name "Spark," the lightning logo, and brand elements are trademarks of Ignite Web Studio. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms, exclusively for your personal, non-commercial use.
08 Third-party services and links
Spark integrates with and depends on third-party services: Apple App Store, Google Play Store, RevenueCat (subscription management), Supabase (hosting). Use of these services is subject to their own terms and privacy policies, which you must review and accept separately. We are not responsible for the availability, content, policies, practices, or products of these third-party services, nor for any damage you may suffer from their use. Any links within the app or website to external resources are provided solely for your convenience.
09 Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, VIRUS-FREE, OR THAT IT WILL MEET YOUR SPECIFIC EXPECTATIONS. SPARK IS A WELLNESS AND MOTIVATION TOOL, NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, PSYCHOLOGICAL, OR PSYCHIATRIC CARE. IF YOU ARE GOING THROUGH A MENTAL HEALTH CRISIS OR EMERGENCY, IMMEDIATELY CONTACT A HEALTHCARE PROFESSIONAL OR YOUR COUNTRY'S EMERGENCY SERVICES.
10 Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IGNITE WEB STUDIO, ITS DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE, INCLUDING LOST PROFITS, DATA LOSS, BUSINESS INTERRUPTION, OR REPUTATIONAL DAMAGE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU HAVE PAID TO SPARK IN THE PREVIOUS 12 MONTHS, OR USD 100, WHICHEVER IS GREATER.
11 Indemnification
You agree to indemnify, defend, and hold harmless Ignite Web Studio, its directors, employees, agents, and affiliates against any claim, demand, loss, damage, or expense (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of third-party rights (including intellectual property, privacy, or publicity rights), (d) any content you submit to the Service, or (e) your negligence or misconduct. We reserve the right, at our cost, to assume exclusive defense of any matter subject to indemnification.
12 Termination
You may terminate your account and stop using the Service at any time by deleting your account from the app settings or by writing to spark@ignite-web-studio.com. We may suspend or terminate your access to the Service, at any time and without prior notice, if: (a) you violate these Terms, (b) you use the Service fraudulently or illegally, (c) your behavior puts other users or our infrastructure at risk, or (d) required by a legal authority. After termination, your license to use the Service ceases immediately and we will delete your data in accordance with our Privacy Policy and applicable law.
13 Governing law and dispute resolution
These Terms are governed by the laws of the United Mexican States, without regard to its conflict of laws principles. Any controversy, claim, or dispute related to these Terms or the Service will be submitted to the exclusive jurisdiction of competent courts in Mexico City, Mexico, except where consumer protection law gives you the right to choose the court of your habitual residence. Before initiating any legal proceeding, the parties agree to attempt in good faith to resolve the dispute through direct negotiation for at least 30 days.
14 Apple-specific terms
If you downloaded Spark from the Apple App Store, you acknowledge that these Terms are between you and Ignite Web Studio (not with Apple), and that Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support services for Spark. In the event of Service failure, Apple may refund you the purchase price (if applicable) under its own policies. You acknowledge that Apple is a third-party beneficiary of these Terms and has the right to enforce them. We comply with the applicable Apple App Store End User License Agreement section.
15 Changes to Terms
We may modify these Terms occasionally to reflect changes in the Service, legal requirements, or business practices. When changes are significant, we will notify you at least 30 days before they take effect via email (if you have an account) and a prominent notice in the app or website. The "Last updated" date will always indicate when they were last modified. Continued use of the Service after the effective date of changes constitutes your acceptance. If you disagree with the changes, you must stop using the Service and delete your account.
16 General provisions
These Terms, together with our Privacy Policy and Cookie Policy, constitute the complete agreement between you and Ignite Web Studio regarding the Service. If any provision of these Terms is declared invalid or unenforceable by a competent court, the remaining provisions will remain valid and enforceable in full. Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right. You may not assign or transfer your rights under these Terms without our prior written consent. We may freely assign our rights in the event of merger, acquisition, or asset sale.
